NYSDEC recently issued a new general permit for construction activity. This permit was issued in January 2020 and was effective on January 29, 2020. With certain exceptions, a Stormwater Pollution Prevention Plan (SWPPP) must be submitted prior to undertaking projects disturbing 1 acre or more in East Greenbush. A SWPPP approved in accordance with the Town’s Comprehensive Zoning Law and applicable NYS standards must be in place prior to commencing land development activity and disturbing soil.

Land development activity includes: construction activity including clearing, grading, excavating, soil disturbance, or placement of fill resulting in land disturbance of equal to or greater than one acre. Land development activity also includes activities disturbing less than one acre of total land area that are part of a larger common plan of development or sale, even though multiple separate and distinct land development activities may take place at different times on different schedules. Certain grading and filling activities disturbing at least 0.5 acres but less than 1.0 acre may be also subject to the Town’s grading and filling regulations.

4-Hour Stormwater Contractor Training Events

Under NYSDEC rules, all construction site contractors and subcontractors must have at least one “trained individual” from their company on their construction sites on a daily basis. Training events are available each year. Please visit the Department of Environmental Conservation to view the NYSDEC training calendar.
