Notice of Public Hearing - 2/17/2021

NOTICE OF PUBLIC HEARING

            PLEASE TAKE NOTICE, that pursuant to a resolution adopted by the TOWN BOARD of the Town of East Greenbush, the Town Board shall hold a public hearing to receive comment on a proposed local law on February 17, 2021, at 6:30 P.M., at Town Hall located at 225 Columbia Turnpike in the Town of East Greenbush, or by virtual means, to consider a local law. At that hearing, the Town Board shall receive comments from the public about a proposed local law as follows:

            A local law reducing the membership of the East Greenbush Zoning Board of Appeals from seven members to five members.

            Section 4.2.1(A) of the Comprehensive Zoning Law of the Town of East Greenbush provides for the establishment of a five-member Zoning Board of Appeals. That section also provides that the Board may, by resolution, increase the membership of the Board of Appeals to seven members. That action was taken by a Town Board resolution on January 24, 1964, resulting in the current seven-member Board. Section 4.2.1(B) sets forth the term periods for the initial five members, and additional provisions for the two additional members added in 1964.

            The proposed local law would amend subdivision (A) to set the membership of the Zoning Board of Appeals at five members, deleting the option to increase it to seven members. There are currently two vacancies on the Board, so no serving Board member would be removed.

            Subdivision (B) is amended to provide for staggered terms of five years, whereby members will be appointed for five year terms, and one vacancy will be filled every year.

            A copy of the local law may be inspected at the Office of the Town Clerk during regular business hours. A copy of the proposed local law is also available on the Town’s website.

Pursuant to Executive Order No. 202.1, issued by Governor Cuomo on March 12, 2020, and advisories issued by Federal, State and Local officials related to the COVID-19 virus, the TEST BOARD will convene the public hearing remotely as follows:

The Public Hearing will commence at 6:30 P.M and shall be conducted through the use of Zoom, a web-based video conferencing tool with local, desktop client and smartphone applications that will allow Board members and the public to participate electronically and remotely by audio and with or without a video connection. The meeting will also be live streamed on the Town’s YouTube Channel.
