NOTICE OF PUBLIC HEARING
PLEASE TAKE NOTICE, that pursuant to the direction of the East Greenbush Town Board, the Town Board shall hold a public hearing on December 14, 2022, at 6:00 P.M., at the East Greenbush Town Hall located at 225 Columbia Turnpike in the Town of East Greenbush, to receive comments from the public about a proposed local law as follows
A local law to provide for the codification of the local laws, ordinances and certain resolutions of the Town of East Greenbush into a municipal code to be designated The Code of the Town of East Greenbush.
The Code of the Town of East Greenbush was last comprehensively codified in 1991, with amendments by local law inserted in that Code through 2006. This means that specific local laws adopted over the past sixteen years are not collated and easily accessible. In addition, the previous codification is available only in book form, and cannot be reviewed or accessed in a digital format.
The proposed local law would enact an updated version of the Code, which would include and interpolate all of the provisions of local laws adopted by the Town of East Greenbush through July, 2022. The proposed new Code does not enact new substantive provisions of law. Basically, the previous laws of the Town of East Greenbush are reorganized in a format making them clearer, and more accessible for the public, Town officials, and Town employees. Certain previously enacted chapters of the Town Code are repealed, but the repealer is limited to provisions which have already been repealed by local law. The proposed local law clearly states that any right or liability established or incurred under a previous legislative provision of the Town of East Greenbush is not affected. Offenses or acts committed prior to the enactment of this new local law, which were violations of Town of East Greenbush local laws when committed, shall still be subject to any penalty or punishment which might result from that conduct. The local law includes other savings provisions for certain previous acts occurring before the adoption of the new code. Certain changes are made to titles of Town officials. For instance, references in the previous Code to the “Town Superintendent of Highways” and “Highway Superintendent” are amended to refer to “Town Commissioner of Public Works”.
A copy of the proposed local law may be inspected at the Office of the Town Clerk during regular business hours. A copy of the proposed local law is also available on the Town’s website at: www.eastgreenbush.org
Also available at that Town website is the actual proposed new Code of the Town of East Greenbush, which is being enacted as part of this proposed local law.
